Welcome to Ubiqio — the smarter way to send SMS. These Terms of Service (“Terms”) govern your use of our website, APIs, services, and related products (collectively, the “Services”). By using Ubiqio, you agree to these Terms.

If you’re using Ubiqio on behalf of an organization, you’re agreeing on their behalf.

1. Your Account

• You must provide accurate information when registering.

• You’re responsible for safeguarding your credentials.

• You must be 18+ and legally able to enter into these Terms.

2. Your Responsibilities

You agree not to use Ubiqio to:

• Send spam or unsolicited messages

• Violate any applicable laws (e.g., TCPA, GDPR, PDPA)

• Harass, threaten, or deceive others

• Interfere with or disrupt the Services

You are responsible for:

• The content of the messages you send via our APIs

• Obtaining consent from message recipients where required

• Complying with regional telecom regulations

3. Our Responsibilities

We provide a reliable, automated SMS delivery platform with intelligent routing, failover, and monitoring. However, we do not guarantee 100% delivery or uptime. SMS delivery depends on many external variables, including carrier performance, DND filters, and regulatory frameworks.

4. Pricing & Payments

• Pricing is transparently published or agreed upon via custom plans.

• You’ll be billed based on usage via our third-party billing provider (e.g., Stripe).

• Late or failed payments may result in service suspension.

• All fees are exclusive of applicable taxes unless stated otherwise.

5. API Usage

Use of Ubiqio’s APIs must follow published rate limits and fair use guidelines. Abuse or unauthorized use may result in immediate suspension.

We reserve the right to throttle, modify, or discontinue access to the API at our discretion for security or operational reasons.

6. Termination

You may stop using Ubiqio at any time by closing your account.

We may suspend or terminate your account if:

• You violate these Terms

• You engage in abusive or illegal activity

• Continued service causes risk to our infrastructure or other users

We’ll do our best to notify you unless legally prohibited.

7. Intellectual Property

All content, branding, and IP related to Ubiqio remains our property. You retain ownership of the data and messages you send through the platform.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

We make no warranties, express or implied, including:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.

• Our total liability is limited to the amount you paid us in the last 3 months.

10. Changes to These Terms

We may update these Terms from time to time. If changes are material, we’ll notify you via email or dashboard alert. Continuing to use Ubiqio means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.
