At Ubiqio, we believe communication should be smart, respectful, and permission-based. We take spam seriously — because your reputation, and ours, depends on it.

This Anti-Spam Policy outlines what we consider spam and what we do to prevent it across our SMS infrastructure services.

1. Zero-Tolerance Policy

We have zero tolerance for spam. If you use Ubiqio to send unsolicited messages, we may immediately suspend or terminate your access — with or without notice.

2. What Counts as Spam

Spam includes (but is not limited to):

• Unsolicited promotional or commercial messages

• Bulk SMS sent without recipient consent

• Misleading content or impersonation

• Use of purchased, scraped, or third-party lists

• Messages lacking opt-out instructions (where legally required)

If you didn’t get clear, provable consent from the recipient — don’t send it.

3. Your Responsibilities

You agree to:

• Obtain explicit consent before messaging anyone

• Provide clear identification of your brand or purpose

• Include opt-out instructions where required by law

• Keep records of consent, in case of audits or disputes

You are solely responsible for the content you send via our APIs, and for ensuring compliance with all applicable laws (e.g., TCPA, GDPR, CAN-SPAM, PDPA, etc.).

4. Monitoring & Enforcement

We actively monitor delivery patterns, complaint rates, and provider feedback to detect abusive behavior.

We reserve the right to:

• Pause message delivery

• Investigate suspicious traffic

• Report violations to regulatory authorities

• Suspend or ban offending accounts

Our automated routing infrastructure may also automatically de-prioritize or block messages suspected of spammy behavior.

5. What Happens if You’re Reported

If we receive a complaint about your messages:

• We may contact you for an explanation and consent evidence

• We may suspend delivery until the issue is resolved

• Repeat violations will lead to permanent bans and legal reporting
